1. General

  • 1.1 InstaMind Education (ABN 72 320 893 690) is a teaching intuitions’ website trading as InstaMind, where you can browse, select, and purchase courses sold by InstaMind.
  • 1.2 Your access to and use of the Site, including your Orders and purchases of Products through the Site, is governed by these terms and conditions and our Privacy Policy.
  • 1.3 InstaMind programs are in-class and online tutor interaction-based. They are conducted in Perth, West Australia, for use by bona fide applicants only, i.e., those preparing for the site listed courses and competitive examinations. Enrolment in InstaMind’s programs is for the applicant enrolled. Enrolment cannot be transferred or substituted for another person in any manner. InstaMind reserves the right to reject/cancel enrolments if any discrepancy is found.

2. Compliance

  • 2.1 By using the Site to browse, select and purchase Products, you agree with us to be bound by, and comply with, these terms and conditions.
  • 2.2 You agree to comply with all relevant laws relating to your use of the Site and your placement of any Order through the Site.
  • 2.3 You agree not to use any data listed on the site for commercial purposes e.g. through price or information scraping.
  • 2.4 You agree not to use the Site for any purpose that is fraudulent, unlawful or otherwise prohibited by these terms and conditions. You may access the Site for your own personal use but otherwise neither the Site, nor any material on it, may be altered, modified, reproduced, transmitted or distributed without our prior written consent.
  • 2.5 You agree to defend, stay harmless, provide respect and indemnify to InstaMind products and all of its directors, officers, tutors and employees.
  • 2.6 While using this Site, you may not:
    • a. breach any laws, infringe a third party’s rights or act contrary to any relevant standards or codes or make any fraudulent enquiries, purchases or requests;
    • b. use the Site in a manner or way, or post to or transmit to or via the Site any material which interferes with other users or other customers or defames, harasses, threatens, menaces or offends any person or which prevents any other person from using or enjoying the Site, or post any spam, unsolicited or bulk electronic communications;
    • c. use another person’s details without their permission or impersonate another person;
    • d. post or transmit any obscene, indecent, inflammatory or pornographic material or any other material that may give rise to civil or criminal proceedings;
    • e. tamper with or hinder the operation of the Site;
    • f. knowingly transmit any viruses, worms, defects, trojan horses or similar disabling or malicious code to the Site;
    • g. use any robot, spider, site search and retrieval application or other mechanism to retrieve or index any portion of the Site;
    • h. modify, adapt, translate or reverse engineer any portion of the Site;
    • i. remove any copyright, trade mark or other proprietary rights notices contained in or on the Site;
    • j. create accounts by automated means or under false or fraudulent pretences;
    • k. violate the security of any computer or other network or engage in illegal conduct;
    • l. take any action that imposes or that would, in our reasonable opinion, result in an unreasonable or disproportionately large load on our infrastructure;
    • m. use the Site other than in accordance with these terms and conditions;
    • o. fail to pay for Products ordered using your login;
    • p. transfer your login to another party without our consent;
    • q. harvest or otherwise collect information about other customers, including email addresses, without their consent; or
    • r. attempt any of the above acts or engage or permit another person to do any of the above acts.

3. Your Account

  • 3.1 We reserve the right to refuse service, terminate accounts and/or remove or edit content if we, acting reasonably, deem that you are acting in breach of these terms and conditions or are using the Site in a fraudulent or improper manner. We also reserve the right to otherwise cancel Orders in accordance with clause 7.1.
  • 3.2 You:
    • a. must ensure that only authorised users have access to your computer and ensure that your login and password that is used to access the Site and the details of your account are kept in a safe and secure manner.
    • b. must notify us if you are or become aware that there is or has been an unauthorised use of your login and password or account, or any other security breach relating to your account.
    • c. must promptly advise us of any changes to your information provided to us as part of the customer registration process.
    • d. are responsible and liable for any person that uses your login and password to Order Product(s) through the Site;

4. Placing an Order

  • 4.1 You may purchase Products by selecting and submitting your Order through the Site in accordance with these terms and conditions. Any Order placed through this Site for a Product is an offer by you to purchase the particular Product for the price notified at the time you place the Order, on the terms and conditions set out as InstaMind Terms and Conditions.
  • 4.2 We may ask you to provide additional details or require you to confirm your details to enable us to process any Orders placed through the Site.
  • 4.3 You agree to provide us with current, complete and accurate details in response to requests by us, to you, for information.

5. Acceptance or rejection of an Order

  • 5.1 In certain circumstances, your Order may be rejected, such as where we are not able to provide the service ordered at that point or if there is an error in the price or the product description posted on the Site.
  • 5.2 Each Order placed for Products through the Site that we accept results in a separate binding agreement between you and us. For each Order accepted by us, we will:
    • a. provide the services for that Order to you in accordance with these terms and conditions (either directly or via our Fulfilment Partners); and
    • b. send you an email confirmation of that Order – though with the nature of the internet we cannot guarantee receipt. Please add admin@instamind.com.au to your contact address book to ensure emails are not sent to SPAM or blocked by your fire wall.
  • 5.3 If we reject an Order for Products placed, we will endeavour to notify you of that rejection at the time you place the Order or within a reasonable time after you submit your Order.

6. Delivery Policy

  • 6.1 We will do our best to provide services for your order by due date. If we can't do that, we will try to let you know as soon as possible.
  • 6.2 Course schedules and locations are subject to change or cancellation. InstaMind will notify you of any changes or cancellations and available alternatives. InstaMind’s programs are deemed delivered once the enrolled applicant participates in person or online.
  • 6.3 You will be responsible for providing the correct email address, and InstaMind will not be in any way held responsible if the email address provided to us is inaccurate, outdated or incorrect.
  • 6.4 InstaMind’s programs are specific to the one you chose at the time of enrolment and cannot change or substituted later.
  • 6.5 InstaMind will ensure that all administrative arrangements for the conduct of the program are well planned and executed. Due to factors beyond our control, if the program cannot be held entirely or partly as intended, InstaMind cannot be held responsible for any such inconveniences experienced.

7. Cancelling an Order for any Course

  • 7.1 We may cancel any part of an Order for Courses (including any Orders that we have accepted) without any liability to you for that cancellation at any time if:
    • a. the courses in that Order won’t be available at that point; or
    • b. there is an error in the price, or the Course description posted on the Site for the course; or
    • c. your Order has been placed in breach of these terms and conditions; or
    • d. the course(s) in that Order have been cancelled.
  • 7.2 If we cancel any part of an Order in accordance with:
    • a. Clause 7.1(a) or 7.1(b) (where the Course is unavailable or there is a pricing or product description error) or 7.1(d) (where the Course has been recalled), we will provide you with reasonable notice of that cancellation and will not charge you for the cancelled part of the Order. If any payment has been taken, then: (i) for a wholly cancelled Order, the full payment amount; or (ii) for a partly cancelled Order, the amount paid in respect of cancelled Courses, will be refunded to your original payment method, or where InstaMind deems appropriate, through an alternative means.
    • b. Clause 7.1(c) (where you are in breach of these terms and conditions), we will provide you with reasonable notice of that cancellation. Provided we are not also in breach of these terms and conditions, a cancellation fee of the lesser of $25 or the value of the payments made may apply. If any payment has been made more than $25, we will refund that excess amount to your original payment method, or where InstaMind deems appropriate, or through an alternative means.

8. Course Prices & Fees

  • 8.1 We will charge you, and you agree to pay the purchase price of each Course that is ordered, and you are enrolled in, and any other fees and charges set out in these terms and conditions. Fees must be paid in full at the time of enrolment prior to the commencement of the program. Prices are subject to change without notice.
  • 8.2 All prices on the Site are in Australian dollars (AU$) and all purchases will be made in Australian Dollars. We reserve the right to alter prices for any reason at any time before you place your Order. Course availability and prices may vary between at the delivery stage and those found on this Site.
  • 8.3 InstaMind will not be liable or responsible for any failure to perform, or any delay in performance of, obligations under its contract with you where such failure or delay is caused by an event outside the reasonable control of InstaMind.
  • 8.4 The purchase price of each Course is shown on the Site at the time you place your Order. The purchase price of a Course on the Site may not be the same or correspond to the prices at the time of delivery of the same Course and we are not obliged to match any prices.

9. Payment methods

  • 9.1 You may pay the fees and charges for an accepted Order with any of the following payment methods and such other payment methods as specified on the Site from time to time:
    • a. InstaMind Secure Pay
    • b. Bank Transfer
  • 9.2 If we are unable to successfully process your nominated payment method for an Order that has been accepted by us, then we may cancel your Order.
  • 9.3 If you choose to pay by credit card, you authorise us to debit the amount that is payable from your nominated credit card for an accepted Order.
  • 9.4 You must not pay, or attempt to pay, for Products through any fraudulent or unlawful means.
  • 9.5 We will provide you with a receipt after your purchase which specifies the total fees and charges for the Courses in the Order.

10. Refund/Return Policy

  • 10.1 Since many programs are face to face programs, sometimes a minimum number of students are needed for each program to provide an optimum simulated learning experience. Depending on actual enrolments for each session, InstaMind reserves the right to cancel/make adjustments to the schedule (without consultation) to allow an optimum learning experience. InstaMind reserves the right to call off the program and inform the enrolled students one day before the program in the instance where a minimum number of students are not available. The total fee is refunded in such instances.
  • 10.2 There will not be any refund for absence. Refund is available for early termination only if notified at least one week in advance. NO fee (full/partial) is refunded if the student changes their mind after enrolment or fails to attend the program or leaves the program in the mid-way for any reason. Returns, refunds or exchanges will not be provided unless there are exceptional circumstances and the decision whether to give a return, refund, or exchange is solely at InstaMind’s discretion.
  • 10.3 A request by email will need to be provided to InstaMind stating your name, contact details, context, and reasons you request a cancellation/refund. Requests will be processed if they are sent within one week of the date of enrolment. In the circumstances of medical conditions, a medical certificate must be sent for the cancellation to be valid and to book the next available session. There will be no refund for informing after the completion of the booked session.
  • 10.4 For all the refunds, admin fee equivalent to 50% of one session will be charged. After cancellation is accepted at InstaMind’s discretion, we will refund the amount to your original payment method, or where InstaMind deems appropriate, or through an alternative means. Refunds for individual components or parts of a package are not permitted.
  • 10.5 If you choose not to proceed with your subscription for the online practice packages, in that case, InstaMind offers you a full refund money-back guarantee, provided you cancel your subscription within 07 days of activation. To receive a refund, contact us at admin@instamind.com.au

11. Termination

  • 11.1 We may immediately suspend, terminate, or limit your access to and use of the Site and (where relevant) your account if you breach these terms and conditions and:
    • a. the breach cannot be remedied; or
    • b. you fail to remedy the breach within 10 days of our notice to you of that breach; or
    • c. if there is an emergency.
  • 11.2 We may stop providing the courses on the Site (or any part of it) available without prior notice. If so, any Orders that we have accepted will not be affected unless the Courses that have been ordered are no longer available or we are prevented from providing the courses, in which case, we will notify you and we will refund to you all valid payments received by us for those Products.
  • 11.3 You may cancel your account at any time for any reason provided that:
    • a. any outstanding matters are resolved (such as a suspension on your account); and
    • b. you have paid all outstanding amounts owed by you.
  • 11.4 There are penalties for any misconduct, including failure to follow the session supervisor’s instructions.

12. Changes to these terms and conditions

  • 12.1 We may, at our discretion, amend these terms and conditions at any time by publishing any amended terms and conditions on our Site.
  • 12.2 If you have an Order that has been accepted by us, the terms and conditions that will apply to the Order are the terms and conditions that applied at the time you placed your Order.
  • 12.3 For any future Orders, these terms and conditions may be different and so we recommend that you read these terms and conditions carefully each time you agree to them prior to placing your Order.

13. Your privacy and commercial electronic messages

  • 13.1 Unless you have opted out, you agree to us communicating with you via various channels and media (including by email, SMS, phone, mail and by advertising on certain websites and social media) about offers, events and promotions. You agree to continue receiving communications from us until the time that you opt out.
  • 13.2 You may opt out at any time by contacting us. There are, however, some messages that we must be able to send you. These include, for example, messages relating to your account, important information about courses that you have purchased, forgotten passwords, or updates to our T&Cs and Privacy Policy.

13. Intellectual Property

  • 14.1 All right, title and interest in all Intellectual Property in all concepts, systems, written, graphic and other material relating to the Site and its contents is owned by, and will at all times remain the exclusive property of InstaMind, and is protected by Australian and international law. Nothing in these terms and conditions will constitute any licence of intellectual property rights to you.
  • 14.2 You:
    • a. must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, distribute in any way or communicate to the public any material on the Site without our prior written consent.
    • b. must not frame or embed in another website any of the material appearing on the Site without our prior written consent.
    • c. may store a reproduction of the content on the Site on your local computer for the sole purpose of viewing the content; and
    • d. may print hard copies of the content for the sole purpose of viewing and purchasing Products but not for any other use, including commercial use.
  • 14.3 You must not use any of the marks or trademarks appearing on the Site or our name without our prior written consent. All materials used in the InstaMind programs are either licensed to InstaMind or developed for InstaMind by experienced content developers and is protected by Australian copyright and other intellectual property laws. The classroom material must be returned to the educator at the end of the session. Students are not permitted to take any materials home without consent due to copyright reasons.

15. Disclaimer

  • 15.1 InstaMind programs are designed to provide knowledge, clarify doubts, and provide experiential learning opportunities under simulated test conditions where applicable. There are no guarantees provided for the outcome achieved by the student in the main exam. InstaMind shall not be liable to you or any third party for any direct, special, indirect, consequential, or incidental damages due to non-achievement of the student’s outcome.
  • 15.2 Access to the InstaMind website and its content, products and services are provided “as is.” The benefits of InstaMind are without any warranty of any kind. Use of the site and its contents are at your risk. We shall not be held liable for any damages you may incur from your use of this site.
  • 15.3 Even if InstaMind has been advised of the possibility of any damages, InstaMind will not be liable to you or any other person or organisation seeking relief through you for any decision made or actions taken in reliance on any information presented by InstaMind, which results in an any indirect, special, punitive, consequential, incidental loss or damage of any nature arising from any cause whatsoever (including, but not limited to, trading losses, loss of anticipated revenue, personal injury, or other indirect loss or damage).
  • 15.4 InstaMind shall not be responsible for any errors or omissions contained on the website or any other forums, whether printed or electronic and reserve the right to make changes to its website content and courses without notice. InstaMind has no association or affiliation with the Australian Council for Educational Research (ACER), WACE or SCSA or any university or other organisation. Enrolment with InstaMind does not represent or include an application to sit the main competitive exam (e.g. GATE, PEAC, NAPLAN). Registration at the concerned authorities is your responsibility.
  • 15.5 We attempt to be as accurate as possible and use our best endeavours to ensure, but do not warrant, that any information provided by us or other content of this Site, is accurate, complete, reliable, current or error-free.

16. Grievance, complaints and appeals

  • We welcome your feedback and endeavour to deal with complaints efficiently, effectively, and confidentially. If you have a complaint, we encourage you to first raise the matter with the relevant staff member. If not resolved, you may forward your inputs with all relevant details as an email.

17. Other administrative terms and conditions

  • 17.1 Advisory – It is recommended that students have a good breakfast/meal before coming to the institution and bring a snack to eat in the breaks (where permitted) if they think they will be hungry. Please note that large spaces like test centres can be difficult to heat/cool. To avoid being too cold or hot, it is recommended to wear clothing accordingly, which will allow you to adjust as per your comfort level.
  • 17.2 Venue / Session changes – Requests for swapping sessions with alternate educator/location – InstaMind allocates students to sessions/rooms/educators based on the availability of required resources and student convenience. Generally, changes cannot be entertained due to the extensive disruption they cause in the overall allocation process.
  • 17.3 Session arrival time- Students must report to the institution at the time advised, and they are responsible for presenting themselves in good health.
  • 17.4 Conduct within the classroom - (a) Some of the sessions could go on for approximately 4 hrs. (b) Clocks are provided in the test room. You may wear an analogue wristwatch and must switch off an alarm or stopwatch. (c) You may consume no food during the examination. (d) Calculators, pagers, stopwatches, audio or recording devices of any kind, MP3 players, digital watches, Apple watches, dictionaries, notepaper are not permitted (e) Please leave the test booklets and answer booklets in the classroom after you use them. Test papers may be self-marked by the students under the educator's guidance. You are not permitted to take any test materials, answer or question booklets from the classroom except the take home score sheet and homework sheets.
  • 17.5 Children (< 12 years of age): Parents are responsible for (a) ensuring the child is healthy and fit to take part in the session without any expectation from the tutor (b) Dropping off and picking up of child at the designated session end time, the common waiting area can be used by parents who are waiting to pick up their child, (c) instructing and ensuring that the child conducts appropriately in the classroom (d) being available in the premises for the entire length of session, if the child is unwell, or has tendencies to deviate from instructions.
